Certificate of Permission to Act in Yukon

CERTIFICATE OF PERMISSION TO ACT

Individuals who are licensed to practise law as a lawyer in another province may apply to the Credentials Committee under subrule 74(1) for a certificate of permission to act authorizing them to provide legal services in Yukon on a single matter as an interjurisdictional practitioner.

Although interjursidictional practitioners are not members of the Society, Parts 4, 5, 6 and 9 of the Legal Professional Act, 2017 apply to interjurisdictional practitioner in respect of their provision of legal services in Yukon.

Authorization to provide legal services in Yukon under a certificate is limited to the particular matter specified in the certificate and expires one year from the date of issue, but may be renewed if necessary.

Applications must be made in Form 8 and accompanied by the following:

• Copy of government-issued photo identification
• A certificate of standing from each governing body, and each body regulating legal professionals in a jurisdiction outside Canada, in which you are or have ever been a member, dated no more than 60 days before the date the application is received by the Credentials Committee
• Fees in the amount of $792.75 ($300 application fee, $455.00 certificate fee plus $37.75 GST)

Interjursidictional practitioners must have professional liability coverage unless exempt.  We recommend you review Division 15 of the rules on professional liability coverage. 

All required records and information must be submitted to the Credentials Committee before your application will be considered valid.

If supporting documentation will be submitted separately from your application, please advise our office.

Where a certificate of standing is required, the Society will accept:

• if the certificate is issued by a Law Society in Canada, the original certificate, or an electronic copy if sent directly to the Society by the issuing Law Society;
• the original certificate if the certificate is issued by a body regulating legal professionals in a jurisdiction outside Canada.

Once a valid application is received by the Credentials Committee, it will be reviewed by the Committee and you will be notified in writing if your application is approved.

Certificate of Permission to Act Renewals

An interjurisdictional practitioner may apply to the Credentials Committee to renew a certificate of permission to act.  A certificate may be renewed more than once.

The application must be in Form 9 and accompanied by the following:

• Fees in the amount of $477.75 ($455.00 certificate fee plus $22.75 GST)

A Certificate of Permission to Act expires after one year unless it is renewed.  If you wish to renew your certificate, you must ensure that your application for renewal is received by the Credentials Committee prior to its date of expiry or you will be required to re-apply for a new Certificate.

The Society asks that you advise our office when the matter for which you have been issued a Certificate of Permission to Act in the Yukon has been completed.
